Unsafe Push chair, using the Raincover = no access to break on push chair.

I purchased a push chair when pregnant (december) and then all the accessories. one being the rain cover. much needed in the UK. The push chair has a hand break which is one of the things I love about it. I checked which rain cover the push chair manufacturer said was compatible and ordered that.
I did not need to use the rain cover until March this year due to the huge hood covering the carrycot (which was then out grown). When the rain cover is on there is no access to the hand break, making it impossible to use the break in the rain. A huge problem for me as I live in a hilly area.
I contacted Baby jogger to be told that it is compatible with the push chair and they don't see it as unsafe or a problem (they wouldn't sell a pushchair with no break though!) . When I pushed further they told me a new cover was coming in about four weeks with access to the break.
I told them I did not feel I should be having to buy a new cover as the first wasn't up to the job as it made the push chair unsafe. This was ignored. Now 9 weeks later they told me (when i chased the launch date of the new cover) I can get one at John lewis.
I am fuming. i have had to buy a temporary pushchair to use until the rain cover became available and don't fancy spending another £25 or so on another rain cover.
Am I right in arguing it is not fit for purpose? Can anyone advise me on wording I can use in my next email?
