Hi I am new to this but I feel the Black Horse are fobbing me off. I had car finance with them back in 2002 to 2006, this was done through the car company. I have contacted the car company and asked them for details but they say they don't have anything, so i then contacted the Black horse and they have advised i need an agreement number in order to proceed with the claim but as the finance was paid off i don't have any records now. I have contacted the bank where the direct debit came out of and they advised it would be on the direct debit mandate which they do not hold - does anyone have any advise as to where i go from here. the only thing i do have is my credit report with the details on but there is no agreement number on this should i go to the Financial Ombudsman???:(

Do Black Horse have the liability on this one or the car dealer? It can be either depending on the set up. Hence why they need to check.
However, they cant just ask you for the agreement number. They have other ways to identify you.
Now that your complaint has been rejected, Black Horse would have given you the option to refer your case to the FOS. You should do this. However, be aware, that if it is found later, you may find the complaint falls apart if Black Horse say the dealer is responsible and not them. In that case, the FOS would not be able to rule as it is pre-regulation. Plus, the dealer wouldnt have been regulated until January 2005 and they almost certainly wont voluntarily agree to consider pre-regulation cases.I am an Independent Financial Adviser (IFA). BH haven't rejected the claim they are just asking for this agreement number to process it. I bought the finance from black horse as its what Toyota used at the time, so my loan was with them. Toyota have contacted me again this morning advising, my agreement never will be on a bank statement, so I'm off to the bank to check if they still have my details. Is it still worth pursuing it with the ombudsman.?0

You can go to the FOS but it may be better to spend £10 and put in a data subject access request and await that outcome.
There is still the risk that Black Horse tell you the car dealer has liability (which is very common as the seller has the liability. Not the lender. Only if the seller is an agent of lender do they carry the liability. Most car dealers are not agents of the lender).I am an Independent Financial Adviser (IFA).
