Freakin, the answer to your question is that you cannot cancel a transaction for the provision of a service under DSRs if you agree that the provision of that service can start before the usual cancellation period is up.
I've not looked at the website you used, but I bet in their T&Cs it says something like "you agree to us starting the service as soon as you request the service".
On page 18 of the OFT's guide to the DSRs...
As you only spotted the 'error' when looking at you bank statement, I can only imagine that any cancellation period had long passed by then.
When was the order placed?
Thanks just what i was after. That is indeed what it states and i understand why a business would want that otherwise we would have to wait 7 days for any service ordered.
It was placed yesterday to answer the question but they have already sent an email covering their starting work position.
I will have to go and re-educate the wife now on the importance of reading the small and in this case large print. Funny how things in plain view can be missed. In her defense you do have to scroll around on her phone to see it all, combined with the button wording and the same wording in the adwords makes it a plausible mistake but she should have known better.0 -

If yes, then thats it.
If they have not provided a service then you may actually have some rights.
I fail to see why you think that this is not what this place is for.I think you are trying to use this place and the DSR's for getting out of an error that your wife made.
Can you honesty not see how your post comes across as condescending?0 -

If I havent then how can I honesty(sic) not see anything?
You failed to see what this place is not for. I don't think it is a place for people to come to project themselves as a higher being than others.0 -

Thank you wealdroam.. at last a sensible reply.
I am really beginning to lose faith in this forum. Why can't people just answer the question without the need to try and get in a sarcastic or belittling reply.
Yes, the OP probably can work out that it was a moment of madness, but all they wanted to know is can they cancel under the DSR's.I will have to go and re-educate the wife now on the importance of reading the small and in this case large print. That's the trouble with mobile devices and the internet - not always that easy to see the relevant information, even when it is there in plain view (been there, done that myself). But, we all learn by our errors, that's what makes us human.“That old law about 'an eye for an eye' leaves everybody blind. The time is always right to do the right thing.”0 -

Is PZH now saying that my original advice was wrong here?
If so please do tell me what was wrong about it or how I was trying to belittle anyone?
Its not my fault the OP didn't like what he was told is it.Dont rock the boat
Dont rock the boat ,baby0 -
I think his problem is the perceived sarcasm in your post without substantiating it further, not that it is incorrect.0

Of course your initial advice was wrong.Do we have any rights under distance selling?Exile_geordie wrote: »You have the right to complete poayment for the 'service' that your wifey bought.
The OP had already paid. Hence you completely failed to answer their question. It took until wealdroam on page 2 to actually provide an answer.0 -
Freakin, can I suggest that you (and maybe others) consider using AdBlockPlus and you will no longer see the sponsored links that various search engines put at the top of their results pages.
Nor will you see many other adverts that are scattered around the internet.
Speeds up page loading as well.
I wonder why more people don't use it.0
