Is this fair?

I have found a house that my partner and I love. We went and saw the property twice and I thought we said all the right things. On the day we accepted an offer on our property, the house we wanted to buy, also went to STC.

I called the EA and asked why he did not call me, so that I would have got a chance to make a offer myself. He said I was too negative when I came the second time and that he knew of people that would make an offer and then lower the price once other buyers are no longer around! I could not believe the cheek of the man! I have to admit I was a little negative because I thought I could negotiate a better deal- but I thought most people do this!

Can I do anything about this? Although I would love to tell the EA to shove the house up his backside, we simply love the house too much to do so!

Can anyone offer me any advice? Can we do anything?

  • If you make an offer they still have to pass it on to the seller, even if it is under offer.

    What else do you be able to expect to do?

    If the house you wanted to buy is sold STC, there is nothing you can do other than try a higher offer which is ethically questionable.

    You were right not to be too positive, as otherwise that can push the price up.

    It's all a game, keep playing. Maybe you will find somewhere even better?

    Yep, make an offer, they are obliged to pass it on. Drop in a letter at the house with the offer in writing, after you have told the EA. to be sure the vendor gets it.

    Make your final and best offer to the EA in writing and also describe your financial /chain situation and see if they get back to you.

  • Even if he has, you are not party to that contract so nothing you can do about it.

    The answer is probably also no.

    Why has house buying and selling become such a game, why make negative comments if you really like the house. You don't have to gush but you clearly made it clear you were not interested.

    Did you ask them to let you know that there had been an offer, even if you did they don't HAVE to tell you. They are working for the seller, looking for the best buyer and they clearly rely it wasn't you.

    Make an offer, the seller may accept but if not you have learnt a valuable lesson in buying houses!

    If it was me I would walk away, an Estate agent such as this is not someone I would deal with - buying a house is stressful enough, life's too short and there will be other houses with different agents.
