Update: They emailed me back today after my reply informing them i'd contact the IPM and they said they will send me a prize equal of higher value as they did not have the original prize instock. Therefore they are sending me Anya Hindmarch studded make up bag with a selection of beauty products. Am very pleased with this. Am so pleased they were understanding about the situation.

Kimberley x

Hi everyone I hope you can help.

I won an amazing prize with beauty recommended FB page for the Yellow satchel bag, yellow ipod and beauty bag). The company emailed me and I emailed them back that night. However the company claim they never go my email and therefore choose another winner as I had not replied in the 10 days specified in their original WEM. I have proof in mysent box that I replied to them. But they say they re-checked and they did not have my email.

This is their reply today:

Hi Kimberley,

I hope you are well and had a nice weekend.

We've seen your posts on the Facebook page - many apologies, we have double checked and unfortunately we did not receive your email confirming acceptance of the prize. As per our T&Cs it is a requirement that we hear back within 10 days of the original email, which was sent on 22nd May.

However, we'd like to send you a goody bag of beauty products so please can you confirm your address so we can get this sent out to you as soon as possible?

Thanks very much, and apologies again for the confusion,

Holly

Today I emailed them saying I would not accept part a prize my full prize and I have proof I sent then a reply email on 22May . I copy and pasted it with the email. I said that if they did not fulfil my prize I would contact the IPM. And for them to get back to my by Friday with an answer.

The problem is I cannot screen grab any of the competion details etc as I am currently away and dont have my PC. I using the hotel MAC. Could someone please screen grab these details for me before they remove them or something.

i am just so down about this and trying my best to enjoy my current break away but tbh its just put a real downer on my day:o. Does anyone know what the chances are of me getting my full prize.

This is the competition I won :

I wonder if their email address is linked to the new Outlook (used to be Hotmail). I have had several people recently say that they have sent an email to me (and have the proof) and I've never received these (and I've been moved to this rubbish new Outlook). A couple of these have been competition-related emails, so I am now concerned that winning emails have been sent to me (wishful thinking, I know!) and I have not received them.

Hope you get this sorted - having the proof should be enough.

I really hope proof of my sent msg is enough but they dont seem to be too forthcoming. I also sent them a message on the 3 June, asking if they got my first message as I never heard back from them. Just seems so unfair otherwise that they picked a new winner. Really hoping if they are not reasonable that the IPM will sort it out for me. I have had to go through the IPM before and they were great I got my prize in the end. Fingers crossed :D

That's upto the company, they cannot be forced to provide it and an e-mail in a sent box proves nothing.

Proving the prize on offer is not the problem it is proving they received the e-mail. (I don't think just sending you one e-mail complies with the IPM code of practice, just having a look at it.

Well technically they have reconfirmed it within their reply to me I did win. And they also in their reply resent me the winning email within their response.. so that would prove they recognised me as the winner more than once.

It's not a need to prove you were chosen as a winner , it's proving they received your claim within the 10 days they allow.

However IPM guidelines do not like short claim periods

    Notification timelines

Social media moves quickly and Promoters are tending to allow less and less time for winners to

    claim prizes.

However, promotional industry best practice advises that you should give at least 28 days from

the initial winner notification (unless there are very good reasons why a shorter period should be

used – for example, if the prize is tickets to an event taking place within the next few days).

Ensure you communicate when and how winners will be notified before inviting people to enter

on your Facebook page to avoid any consumer disappointment.

Be aware that very short timelines are frowned upon by the ASA, CAP and the IPM (except as

noted above) and Promoters could find they receive a challenge or a complaint to the ASA.
