Civil Enforcement Ltd Parking Charge Notice

Hi,
I recently got a parking charge notice from CEL. For this period i didn't even get out of my car, I was waiting in the area for 25 mins as there were no available spaces to park whatsoever and following a failed attempt at parking moved swiftly on. CEL have now attempted to charge me £75 in 14 days or £150 in 28 days for the pleasure of not being able to find a space in their carpark.
After reading posts I'm really not sure if I should reply or just ignore them. A lot of places say to ignore but I'm aware some say they've been taken to court? This is the first time i've really appealed or repudiated something like this so am quite nervous in doing so as I'm not exactly sure of my rights, but I really don't feel as though i should be paying £75 to these people when I couldn't even park there if i wanted to!
Any help would be really appreciated.

Glad you've followed advice to start new thread, so let's get things underway.
Presumably you've received a Notice to Keeper (NtK) from CEL? If so how many days elapsed between the date of the 'offence' as stated in the NtK and the date the NtK was sent out to you?
Please confirm that the document is a NtK.
Does the NtK refer to the Protection of Freedoms Act 2012 (PoFA)?
The dates are very important, as if issued under PoFA, there are some strict criteria which have to be achieved by CEL. The NtK should be checked by you against this checklist - in every respect - because if it fails on any, the PPC is on thin ice.

So have a look at this and let us have the dates above..... then further steps to follow will be provided.

I'm not sure if it is a NtK or not, as I'm not sure what this is if it's a letter to the registered keeper then that's the one. It states Parking Change Notice at the top of the letter, with issue date 9 days after the incident date. I recieved the letter on the 10th day.
In regard to the checklist, I've added answers below:
1. Not stolen
2. Still during 28 days
3. N/A as yet
4. Unsure if there is a contractual right?
5. I did not recieve a Proection of Freedoms act (Notice to Driver) parking ticket and my vehicle was not stationary in the car park i.e. parked. However have recieved my letter.
6. Think they're within their timescales
7. Not exactly sure what this means, if this is in relation to signage i did not see any that advised waiting to park was subject to charge.
8. Vehicle was not hired.
Hope this is all you need, if it's too much then I apologise in advance!!

Also I'm not sure if it's relevant or not however the only reason they've cited for the charge is 'Payment not made in accordance with terms displayed on signage'.

Are you able to upload a redacted (any identifying details removed) copy of the Parking Charge Notice - use photobucket or tinypic (both free). We can all take a closer look.

If you do show a (broken, incomplete) link to the picture of the letter then make sure you cover all refs and barcodes/pics/location/times/date!
I suggest you just read other threads on the first few pages here and send a simple challenge written in the third person (not saying who was driving and not particularly saying anything about what happened) like we advise everyone to do at this first stage.
In reading other threads about any PPC, you'll also be seeing useful advice and links already posted about POPLA = the second stage where we can help you to win if you word it right.
Happy reading, it really is worth reading current threads like your own (any PPC). Learn what constitutes a strong POPLA appeal now and you will be ahead of the game and looking forward to winning at their expense. Since we learnt the sort of thing POPLA like (March onwards was when we saw their first pattern of decisions) we haven't seen a well-worded strong appeal to POPLA lose yet, when guided by example wording in threads here and on pepipoo forum.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
