Sick and Seld Employed

My partner is self employed and I work 2 days a week. We get my wage and working tax credit. He's been diagnosed as having Colon Cancer so needs to take time off work for an op and recovery. Is there any sickness benefit he can claim or will that just mean the working tax credit will stop? Before getting WTC about 4 years ago, I don't think he paid a NI stamp
There will always be:

    Your partner can claim Employment Support Allowance as soon as he stops working. He will require a fit note from his doctor.

    He will continue to be entitled to working tax credit for 28 weeks after he has stopped work as he is still recognised as being self employed.

    Please make sure you let tax credits know of the change of circumstances.

    If you are employed part time then you may be entitled to Statutory Sick Pay. You may be entitled to contractual Sick Pay instead (according to your contract of employment) The minimum an employer can pay is the SSP amount but they can pay over this amount. However, you must be eligible (see link)

    If you are not entitled to SSP then you can apply for ESA although I believe your employer would need to complete a form saying why they weren't paying you SSP.

    The same 28 week of tax credits would apply as you are considered to be 'employed' for that period of time.

    So is it a SC1 he gets from the job centre? Because when he went there nobody seemed to know whether he was entitled to anything or not and told him to phone the help line

    Sorry to hijack thread but wanted to ask about the 28 weeks working tax credit as I was self-employed and signed off sick so was told I had to claim ESA and my working tax credit was stopped after a 4 week run on??

    Can someone let me know what should have happened please as Im by myself with two kids and now DWP are messing around and not actually paying me ESA (income based) yet so I have very little income :s

    Hi can I hijack too .. We in same situation , husband self employed and went off sick & informed working tax credit & we had 4 week run on too not entitled to any longer and also being messed around income esa ! He's thinking going back in next few weeks after completing cardiac rehab he has been off 27 weeks now ..

    The only SC1 form I can find is here:

    Personally I would be telephoning them and seeing if you can do a claim over the phone.

    Have searched and searched but can not find where you get the form from!

    Let us know how you get on as it may be useful for someone else.

    Please check the eligibility criteria and, if appropriate, telephone and ask why you are not getting the 28 weeks.

    Did you ring tax credits and mention you had stopped working? That is probably why they ended the claim, and they didn't realise that you were still entitled.

    You need to file an appeal against the tax credits decision you received after you notified that change providing you are still in time for doing so.

    But if you continue to get tax credits then it would be taken into account as income for Income related ESA (not contributory ESA).
