Hi there,
I know there are quite a few threads regarding but I just wanted to get your opinion on my situation.
I parked in Tesco for 5 hours (the limit was 3 hours) and have now received a parking fine. they have photos of my car and are demanding I pay them.
they have mentioned a new law effective from 1st Oct 2012. I've read your replies about not paying and ignoring but I’m worried this will snowball and I’ll end up with a big fine at the end. Should I just pay now or ignore?
Thanks,
M

You have not received a fine.
Read all the posts and take the appropriate action.
Who is "they" that are demanding you pay them?0 -
Well they are useless scammers, is this in England or Wales ? Did you get the invoice within 14 days of it being on your car? When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Hi,
I used the carpark on 14th May and the date of notice says 29th May (15 days/11 working days). This was issued in England.
Thanks for your help x0 -
Well they have failed to abide by the Protection of Freedoms Act 2012, they must get the notice to you within 14 days. They cannot therefore hold the registered keeper liable, and you as the registered keeper are not obligated to name the driver.
I would write back to them with a challenge on this
Dear Scammers
In reference to your fake parking ticket reference xxxxx dated xxxxx , the keeper denies any liability to your company, as you have failed to abide by the Protection of Freedoms Act 2012 by not sending out the Notice to Keeper within 14 days.
Therefore you cannot hold the keeper liable, and the keeper refuses to name the driver as there is no obligation to do so. I will not correspond with your company further.
Any further contact from your company or your agents apart from confirmation of the cancellation of your fake parking ticket, will be deemed as harassment under the Protection Against Harassment Act 1997.

That's just 'round one' of the challenge covered (make sure it says 'Protection from Harassment Act' as above). Please read the forum in the meantime as you will need some knowledge of POPLA appeal wording ready for 'round two' when the scammers reject. POPLA is the important challenge which has to be worded differently so it's important you read some other threads talking about POPLA appeals (any PPC not just your scammers).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
