Newcastle Airport Parking Fine

On Sunday 2nd June 2013 I arrived at the long stay car park at Newcastle Airport at approx 3.30am in the dark, parked the car up and walked up to the airport as there where no buses available. I must point out that it being dark and damp and the signage wasn't very clear as they had moved the staff car park area temporarily into the main car park. On my return I had received a ticket from ukpp stating I had parked in the Staff Area and the reason for the ticket was Obstruction. There was no way I was obstructing anything. Can anyone tell me my rights please

    Newcastle Airport car park is definitely subject to byelaws:

    Be aware that the byelaws do provide for clamping and towing, and they may well try to (probably illegally) clamp or tow over alleged past debts if you park there again.

    That said, since the land is subject to statutory authority, it follows that RK liability does not apply, so I would ignore this one, since the legal position is essentially as it was prior to 1 October 2012.

    If the paperwork falsely claims that the RK is liable under PoFA, then a complaint to the DVLA and Trading Standards would seem to be in order for "a misleading commercial practice".

    Well I wouldn't ignore any fake PCN these days from an AOS member issued in England/Wales. We are having a lot of success using the POPLA system to appeal and get these cancelled. Even when issued at Airports where POFA does not apply (interesting that these bylaws do indeed allow for clamping and towing so you were lucky to get this piece of trash on your windscreen instead!).

    Read some threads and wait for the Notice to Keeper to arrive in the post. You need to see the sort of challenge wording we recommend so you can make your own mind up whether to appeal and win it at POPLA (free to you but costs the scammer PPC money).

    Is this UKPPO or UKPC?

    Just wait for the Notice to Keeper - there are good reasons to wait and not respond to a windscreen 'fake PCN' unless you aren't the keeper (if it's a company vehicle or hire car you must appeal sooner just to hook the scam away from the hire/lease company goons who may just pay it).

    This isn't about what your 'rights' are. This is an invoice not a fine and not a statutory notice. It's a scam, read some threads and see this for what it is.

    UKPPO are not a big player - a very small fish in the PPC World pond. It would be interesting to know if they do send a compliant Notice To Keeper 'NTK' in time (check against the Parking Cowboys website, 'keeper liability' checklist page which I can't link here as I am at work having lunch at my desk in a school classroom!).

    Either way you will have grounds of appel for POPLA because everyone does with any PPC (and I don;t think I have seen a compliant NTK yet!).
