e-cigarettes and dsr

Does anyone know if e-cigarettes are exempt from dsr?
I've never heard that they are, but practically all the websites I've seen that sell e-cigarettes and e-liquid don't seem to accept returns.
Maybe there is some clause I'm not aware of?

    Assuming you haven't opened the items and tried them out I shouldn't think there will be a problem. But most of the parts will be regarded as consumables (a bit like batteries, you could open a pack of batteries and use all the power in less than day).

  • I don't know what the legal position on this is, but I bought a resusable pack of ecigs (the more expensive kind not the £7 ones). They were of extremely poor design and I was able to return them and was sent another set, which were a little better (well at least they worked). I'm afraid with e-cigs, u do tend to have a lot of items u've bought but didn't like, it seems to be the way it goes which is a shame.

    Not sure I'd want to share an e-cigarette with someone that could have the raging herp.

    I would think they could refuse to refund for the e-cigs for the same reasons that you can't take earrings back. ie it being unsanitary once there's the possibility that they've been in someone elses body.
    Though this would only apply had they been removed from the packing card/plastic.

    Regarding the bottles of e-liquid. Maybe if they're not wrapped in anything but the bottle, (which may not have a seal inside) it would be too easy for people to replace the liquid with something else?

    I was in particular referring to the atomiser/cartomiser part of an e-cig which tends to be advertised as single use (in some cases), to life expectancy of a few of fills. The warranty offered tends to be against them being DOA (dead on arrival). Having said that I would be miffed if one didn't last around a month.

    Depending on the type the only other thing is a rechargeable battery, which again although not disposable does tend to have a fairly limited lifespan. I get around a year on decent battery before it starts to fail and that would be alternating with two, they would be charged once a day. Some batteries with lower output would need to charged more frequently and as a result would start to fail sooner.

    I fell out with TW one time where the had a sale of 30% off after my order had gone in but before they posted it. I think it was for about £70. I asked for an extra pack of atomisers (or similar worth less than 10% of the order) they refused.

    So as soon as the order arrived I sent it straight back in the meantime I bought at the sale price. It cost them £15, me £5 return P+P but I was still up £10. If they had just done as I had asked it would have cost them £5-£6.

    Now I try not to buy anything from if possible (but I am sometimes seduced by their sale prices) so they have lost a lot more in the long term.

    Not sure what your complaint is here, as in this case dsr worked in your favour. The vendor didn't do anything wrong here.
    But this still doesn't answer the initial answer, but hopefully there will be someone more knowledgeable than me who can answer.

    Dsr are a legal requirement, it's not about vendors or customers opinions of what is desirable/ethical/hygienic, either they apply or they don't.
    Some items are excluded (e.g. custom made goods, food), but I'm not sure if e-cig and e-liquid are excluded too. But I've never heard consumables being excluded.
