In July 2010, I received a summons out of the blue from the local authority who wanted to impose an ASBO on me over a neighbour dispute.
Obviously, I had to find a solicitor who I thought was capable of defending me.
I was shocked that because I was a private client as I was turned down for legal aid, that they charged me a whopping £7000.
Luckily for me, a relative paid as I simply didnt have the money.
Anyway, looking back now, I believe the solicitor was negligent.
They failed to formally object to the Council in writing over the asbo application.
The evidence in the last 6 months was very questionable as there was evidence to show the elderly couple had repeatedly lied in police statements and on asbo log sheets.
The evidence was too old and that some of the statements and log sheets were over 2 years old and the police have just recently told me that they can only use evidence for the past 6 months!!
The solicitor failed to complain of the above.
The solicitor also failed to put in a defence BEFORE the trial.
They have also lost BT phone bills and photographs when I got my paperwork back.
The Council told me my side failed because there was no defense.
Do I have a claim for solicitor negligence?

You may. In the first instance, have you formally complained to the solicitor you used?0

I have found a solicitor who is reviewing my file tomorrow on a no win no fee basis. As it is professional negligence, I can apparently claim anything up to £15K, plus the fees I paid ontop.0
