Online False advertising. Can I.......

Hi just some advice on false advertising.

I've been looking at new mobile phones on prepay. Now I came across a deal for a phone I liked. This was on a comprising site. It said with a logo across it cheap deal next to it the pricing of the phone was "FREE NOKIA LUMIA 920"
Now I thought that can't be right but all the other phones had prices on.
So I clicked the deal and it says your deal free nokia 920 - order direct with the network - delivery in days

Then its got the picture of the phone with a pricing box saying FREE nokia 920 = pay as you go order now.

When you click to order now the price goes to 399.99 and 10 for a top up.

would this be false advertising? if so who would i report it to and could i get that deal. It is very miss leading and i would also like to point out that theres no astrix over any of the ad like subject to pricing etc.

I will be honest, i want to try my luck with it

Thanks in advance

'Comprising' site? Do you mean promising? We need a link to the site.

    I assume they mean comparison.

In the absence if more clarification - no, you can't insist they give you a free Nokia 920.

It's not actually orange advertising the incorrect price so I don't really see how they can be held responsible for it.

If I were to set up a website and advertise that a supermarket is selling every item at 20p you can't expect to go to the supermarket and only pay 20p for every item you buy, you will pay the price they advertise themselves and you couldn't hold them accountable for something I have done that they have no control over

If I were you I would drop an email to Uswitch telling them they have incorrect information and also an email to orange telling them that uswitch are wrongly advertising an offer and naming them as part of it.

It won't get you a free £400 phone but it will get the advert taken down or changed.

Your link no longer works. It may well be that you've misread something (such as the phone being £0.00, as part of a £xx per month contract for yy months).

The link did work earlier when I checked it and OP was correct, it was showing the phone as being free on PAYG, no mention at all of a contract. It was obviously a mistake that has now been noticed and rectified.

If that's the case, then the OP has no case (not that he really had one anyway). It was obviously unintentional rather than misleading.

  • Just stop and think about it. You actually thought that a company could give you an expensive phone without contact and on a pay as you go basis? Of course it was an error!

Just how do you expect that the company could make any money by giving away phones??

I can't believe how thick people can be.
