A few days ago I took my disabled daughter to Mersey Retail Shopping Park. Even though we have a blue badge I usually park in the public spaces because it's easier for me to get the wheelchair out of the boot. I wanted to take her to the pet shop and for the first time ever parked in the completely empty disabled bay in front of the shop.
I got her wheelchair out of the boot and took her in to see the rabbits and when we came out there was a parking ticket from UKCPS Ltd for £100 (£60 if I pay within 14 days) for parking in a disabled bay. Silly me, I had forgotten to display the blue badge. It is a huge car park and the fact that there are no parking meters tend to give a false sense of security.
From reading the forums I understand they associate themselves with a disability organisation and I think that is shameful! If they were really representing the disabled then the ticket should be null and void if a blue badge can be produced but I understand they have fined people for displaying the badge the wrong way around, so no empathy there!
Life is hard enough without being pounced on by money grabbing scammers like this.

    Stop giving these scammers any credence.

    The Blue Badge Scheme does not apply on private property, no matter what their rubbish signs claim.

    Its the Equality Act that applies here and your daughter is entitled to use an accessible space regardless of her having a badge or not.

    Your first step should be to approach the store concerned and insist that they get the ticket cancelled as they can be held jointly liable for Equality Act breaches like this. If they don't play ball, you may have to demand that the PPC cancel the ticket or issue you a POPLA code, and you should be able to overturn this at POPLA no problem, or raise an action against the retailer.

    Dear Scammers,

    In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company. Enclosed is a copy of a blue badge that confirms the vehicle had a disabled person on board. If you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 2 of the BPA Code of Practice.

    The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the timeframe stipulated above.

    Thank you Pogofish and Stroma for the advice and sorry about delay in responding. I'm new to these forums and still navigating my way around them.

    I did ring the store and was informed they had nothing to do with the car park. I then rang the contact number for Retail Park and because it was a Sunday, got through to security. I asked who 'managed' the complex and was told it was Savilles but advised to write to the company that issued the ticket. The security called me back (caller ID) and said if I'd received ticket that day they could have it removed but I told them I'd had it a few days and they said they couldn't help.
    I am reluctant to enter into word games with ticket issuers. I am 60 and my daughter is in her 40's with a mental age of 2. I care for her 24 hours a day and I don't have the mental energy to take on these people, however, deep down I know I can't accept this kind of harassment.

    Please don't enter conversations with this situation, just send what I posted above to ukcps, they will reject it out of hand, and they must give you the popla code, we can help you with that, this again is sent to them via email so no effort in it beyond reading a bit and understanding the appeal you send in. Just read some of the newer threads here about that

    The POPLA appeal would need to cover other things than simply relying on having the Blue Badge but not displaying it, as Stroma posted here ( post #53) http://forums.moneysavingexpert.com/newreply.php?do=newreply&p=61756299

    Shamefully, POPLA rejected the appeal as they said the motorist failed to agree the parking conditions of displaying the Blue Badge..

    So don't submit any POPLA appeal without getting some help either here or pepipoo.

    I would persevere with the retail park or even local paper as well.

Due to some sort of an event, the carpark was full, even though they kept opening the barricades to let cars in. i went around the car park twice 9including overflow car park). eventually after 20 mins as I could not get out and had dropped my children in, I had to find a slot to park to ensure they were alright. I eventually found a place (not a disabled bay). I came back after about 2 hours and to my diappointment I found a parking ticket. The amount is extortionate £60 for if paid within 14 days?? the car park is supposed to be free for users of the comples as long as they have used services within the comples. Apparently that area was to be used by permit holders-but there were lots of spaces and I wasnt blocking anyone in. WHat do I do?

    I have learned so much on the short time I've been on this forum. The fact that DVLA dole out our personal details to these scammers has to give them an elevated sense of importance and credibility. I'll be contacting my local MP about it as I'm not a happy bunny. :D

    I really would not leave it at that, because UKCPS will not.

    POPLA is just one more stage and is just an email or letter, free to you (costs the scammers £27 plus VAT to fund each appeal!) and will cancel the harassment and stop all the scary letters when you win - and at that stage you can use the example POPLA appeal wording I gave you (suitably tweaked).

    And as for this first complaint/challenge, I wouldn't waste Recorded delivery, just send 1st class post at the PO (get a free certificate of posting, that's fine) and word it in the strong format of my template complaint letter, demanding a POPLA code.
