Parking Eye successful appeal

I was parked in Southend airport retail park on 20th april 2013. I got a parking charge notice for 100 pounds reduced to 60 if paid by the 25.05.13. Time limit in car park was 3hours, i was in there for 3hours & 11 mins. They have cctv cameras on entry & exit. I appealed online, explaining that the shops were very busy, it was a sat & did not realise that i had gone over the 3hours. I got a letter back from parking eye, dated the 14th may, asking for evidence that i had been shopping. I sent back receipts & bank statement clearly showing airport retail park southend. I got a letter dated 4th june 2013, saying that the charge had been cancelled & there is no outstanding payment due.

I'm happy for you that you got this cancelled, but why don't you ask your bank about sending bank statements to unregulated companies, I am not saying its likely but you could have left the door open for identity fraud.

This company like all the others are not an ethical company, they are not authorities and they have have no damned right to your financial records, who the hell do these people think they are ?

You have your win, but I think even if you sent redacted statements its not something you should ever do again.

I only sent a photo copy of a very small part of statement with no account details on it. I would not send them a full statement as you rightly say, they have no right to see your personal financial details

Glad to hear it , but even asking for bank statements is a despicable thing to ask for, how many would send them the whole thing ? They have no damned right to even see a tiny part of a statement. And there is nothing anywhere that says that the evidence should include sensitive information like this.

So once again PE are stating that you must produce proof that you spent some money before they will let you off. Why isn't this flagged up on the signs displayed in the car-park? This amounts to a "secret" clause in their T&Cs which the ordinary motorist cannot be deemed to have agreed to because they have no knowledge of it.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

I agree. A secret clause = an unfair term.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Glad to hear your appeal was successful glenloch :)

trisontana - that they don't state this clause on the "Parking Charge Notice" is really quite annoying. I guess they're hoping that by not disclosing, some people will just pay up even if they have spent. Grrrr.
