Reclaiming from Lloyds

Hi,
My husband has PPI on a loan taken out with Lloyds at the end of 2007 - it has been added to the loan and comes to £3234 (for the PPI). Lloyds recently sent him a questionnaire to complete about taking out his PPI and it was only at this point that we realised that pre-existing medical conditions might exclude him from cover (he has chronic asthma, medication daily, and had kidney faliure and a kidney removed in his 20s). I have found the original documents and they do include leaflets/ T&Cs that state these exclusions but he does not remember being asked explicitly about them on application or anyone explicitly saying that these would not be covered (obviously these are the reasons he is mostly likely to need this cover re. illness/ hospitalisation etc.). I think with this information he should have been advised that the cover was not suitable for him? Problem is we have no proof of this. Is it worth a claim?

A bit more info - this purchase was a result of a conversation with Lloyds staff as it involved refinancing an original loan, so not just a tick box/ opt in. However, we inevitably have no record of the conversation.0

Sorry - a bit more info. At the time he was also working for Tesco in a line manager position - still is as senior manager so had benefits which would have covered him too. Basically the policy was not suitable for him but for some reason he still opted for it and still has it on the loan as it was added in to the total amount. He has had money probs in past so tends to be really concerned about issues like this although we are in a really secure position now.0

Just complain and give your reasons as he was in full time emplyment with excellent benefits and a pre-exisiting medical condition therefore didn't need it and it wouldn't have been suitable.Non me fac calcitrare tuum culi0
