Can anyone help with this . I have an appeal going on for DLA and had a home visit from doctor. He came in and asked me to sign some form which i did , Then he gave me the once over and told me i would be hearing from dla which i have since telling me i have to go to a tribunal . They enclosed the doctors report which was not accurate in that he had not wrote down exactly what i had told him about my condition. I have since been told that i should have been shown what he had written and then asked to sign. Is this correct ? I know he puts in his own conclusions but the answers i gave him should surely have been checked by me before he left . CAB have told me that some EMPs do this in case they get a punch in the nose, which i can assure you he would not have had. Anyone know anything about this please ? .

You're meant to sign the bit after he's written what you've told him but I wouldn't bother too much about that as it's the clinical findings that hold more weight on an EMP report. You'll get your chance to say your bit at the hearing.0

Until a few months ago the EMP was required to show you your statement to read and sign before he left. This has now changed and they do not have to let you read back anything they have written.0

Could you demand to read it before they leave or demand to sign it after reading?Problem with having access to internet is that i get asked by many to solve their problems

I suppose you could try but they do not have to show it to the claimant anymore so I guess it would depend on the Doctor.0

The same happened to me. He never asked me to sign anything and didn't show me the report. i was refused DLA and rang to enquire about appealing and the lovely lady on the phone went through the docs report and it was nothing like I told him and he completley ignored my main problem even though I told him I was waiting for another op! I am appealing but was initially really upset because he'd made me feel a fraud.0

always phone rthe DLA for a copy of the report, even if you get awarded DLA, that way you can see what was going o in their brain at the time.
