12% restocking fee

I have bought an item for the GP surgery that I work for and it has not yet been paid for, as we have an account, we want to return it as we don't need it. The company wants to charge a 12% restocking fee which would be around £40 I am within 28 days returning it unused. Can they do this?
I don't have a signature yet....

This sounds like a business-to-business contract, so if the T&Cs of the contract state this then yes they can.
Even if it was a consumer contract then you are (probably) outside any cancellation rights afforded by Distance Selling Regulations. (Assuming you bought online/mail order).0 -
They don't even have to accept it back if they wished to play hardball in a b2b contract0

Where does the 28 days thing come from? Is it part of their returns policy or something? If so, read the terms of this and check.
As for as consumer protection is concerned you have 7 working days to notify them of your intention to cancel, but this does not appear applicable because it was bought in a business capacity, thus outside of the scope of distance selling regulations and you seem to have passed this time limit anyway.
So it would seem they can do this.
The fact no money has changed hands yet is not relevant.0
