Well, it also depends on why he specifically requested it. If he was advised to over the phone, then fair enough, if he merely chose with no outside influence, then that's different.

Are they likely to still have a recording of his phone call , it was in October 2001 with Morgan and Stanley, or is it a case of his word against theirs?
The card was taken over by Barclays, dont know if they are tough to deal with or not.

No - after 12 years, I doubt it! It was there for their security, and not mandatory. Only in the late 2008s did it become a requirement and the max retention period was 24 months - you can safely assume it has been wiped.0

Just want to say I got a letter back from MNBA today, saying complaint upheld and a cheque for £1800 is on its way, I am delighted ! thanks for the advise everyone.

Well back in 1995 I "ticked the box" and was turned down by Barclaycard for that very reason. I was self-employed at the time. Two years later FOS have upheld my claim because they felt that I would not have been likely to have made a successful claim on the PPI and the wording in the original leaflet were not adequate for me to have made an informed decision about whether the PPI was suitable. So yes you can "tick the box" and get your PPI claim upheld!0

thats great to hear Vintagevamp, my husband is very easily influenced and is a real "family guy" so when he saw the wording "protect your family against ..." he did exactly that and ticked the box , out of interest did you still have a copy of the original leaflet or did the company supply you with a copy.0

No I haven't got the original flimsy leaflet. BC sent FOS a copy and they weren't too impressed with it so that is why my complaint was upheld. I ticked the box because I honestly thought that as I was self-employed I would be adequately covered by their policy and less likely to get the card if I didn't. Luckily FOS agreed with me and BC have now got to cough up the lot, and the card is still active.0
