Gift cheque stopped and BS are charging 6yr old

Hi
My child was sent a cheque for Christmas. I posted it off to the BS where she holds her Child Trust Fund account (her only account).
I received a letter back saying the cheque had been received and would be credited to her account.

Today we received a letter stating that the cheque had been returned by the bank 'refer to drawer' on it.

They then went on to say that there would be a charge of £30 for this cheque and remittance should be sent to them in due course.

So my child is sent a gift which is actually 'wrapped up nothing' and to add insult to this, she has to pay £30 for being treated in this way. When she has done nothing wrong.

Can they do this?
Does anyone have any advice on what to do next about this.

    I don't know the answer to your question. However I would be miffed if I wrote a cheque at Christmas & somebody was only just cashing it.

    Have you checked with the person who gave the cheque to see if they have actually put a stop on the cheque?

    Just read your thread again, refer to drawer could be down to lack of funds in account. They may not of stopped the cheque.

    Speak to the drawer of the cheque..........

    I would imagine that they have forgotten all about it.

    I would like advice on what to do regarding the charge they intend to impose.

    Sounds like it has bounced. Not surprising. It's nearly 6 months down the line, they may have presumed it had gone out.

    I very much doubt the sender intended to give her a dud check, I expect they'll mortified. So I wouldn't sound so precious.

    With regards to the charges, you'll have to look at the t&cs on the account.

    Only if they still have enough funds in their account to cover the cheque! Look at the account t&c's regarding the charges.

    What building society is it?

    I know you point out the child is 6 but is the account in just there name? Most accounts for children require an adult attached to it in one form or another. Therefore they are actually charging an adult not a 6 year old.

    I do not want to pursue the amount of the cheque in anyway.
    I would simply like advice from anyone who knows anything about the amount of the charges and whether or not they are correct in applying these since it wasnt our fault and we acted in good faith.

    check their tariff of charges applicable to the account to make sure they have applied the charge correctly. Most banks have a range of charges covering things like bounced cheques, refused SOs and DDs, unauthorised O/Ds etc.

    If they have then it would be best to resolve the problem of the cheque before asking the BS to refund the charge.
