I've bought and paid for a garden furniture set on ebay that is due to be delivered around mid/late June.
My question is can I cancel this order and get a refund.
The seller is a business rather than a person and I paid by credit card.

Hi and thanks for your response.
Its not made to order - part of a container shipment
Will have to look at the sellers T+C's
Cancelling as my wife decided to buy one from a garden centre and paid cash so not much chance of cancelling the cash buy.

As you have a right to return for a full refund - most sellers would happily cancel to aviod that.0 -
Quite a typical scenario for such purchases with large delivery windows. Email the seller and ask to cancel, I suspect they will oblige without issue, but if they don't you do have a right to cancel and eBay will refund, but not really necessary at this point.0

I've just pulled the below off the sellers website. It would seem I can cancel before receiving the items.

Returns to be made within 7 days of receipt at buyers expense
Most Buy It Now purchases are protected by the Distance Selling Regulations, which allow you to cancel the purchase within seven working days after the day you receive the item.
Also pulled the below off:Order Cancellation & Refunds
Should it be necessary for us to cancel an order due to customer error, we will send an order cancellation request via eBay. This request must be accepted by the customer prior to any refund being issued. If the request is not accepted, we reserve the right to deduct a 12% administration fee from any refunds issued. Please understand that by placing your order, we have already been charged ebay fees and by accepting the cancellation we can recoup those funds and provide you with a full refund.

If it were me, I'd be telling them to 'waive' the administration fee as it is not chargeable under the DSR and only then will you agree to the Ebay cancellation. In the meantime, specify that you are cancelling the order applying your rights under the DSR.0

Is there something I'm missing from the Ebay cancellation point? Seller is saying if OP agrees to Ebay cancellation (so that seller gets fees refunded by Ebay) then they have no problems with issuing a full refund. Why wouldn't OP accept the Ebay cancellation?0
