Scan Computers - Acer Laptop

Hi, I bought a laptop yesterday from Scan Computers. It's an Acer Aspire v5-471 NX.M3SEK.004. On the Scan website, their ebay page and Acer's website it is advertised as having a 10 point touch screen. I double checked that it had these features when I bought the laptop with the sales person.
The laptop arrived this morning and it doesn't have a touch screen. I checked all the codes on the computer and they tally. I just ran scan and they said it has been wrongly advertised and would not be a touch screen at the £343 that I paid and offered me a refund.
I don't want a refund. I want a V5-471 with a touch screen that was advertised (and which acer do) for the £343. Do I have the right to ask for this or do I have to accept a refund?

You can ask, but they can refuse.
IMO I'd take the refund, They've changed their adverts on ebay to remove all touch screen references for your model so it's not like they are still promoting bad information.
Mistakes happen and unfortunately Acer have several models with the same model number with varying specifications, so easy to make a human mistake.
You COULD take it further down the court way under loss of bargain (but I'm very dubious about results) but that would take months and months to hearback.
I'd take the refund and ask for some sort of goodwill gesture/discount code (if they give you a goodwill gesture or discount great, otherwise take the refund and shop elsewhere).0 -
And make sure they refund you for the postage both ways - i.e. including the cost to return the goods. (Assuming they don't collect).0

No you don't.
If you wanted to be really pedantic you could go down the breach of contract/loss of a bargain route.
However the end result depends on the judge on the day. If he feels scan have behaved well and it was an obvious miss price. They may well find in your favour for the difference, but nor their or your costs.0 -
A retailer does not have to sell you anything if they decide not to.
So it looks like the refund route.0
