DWP SAR request - should ICE refuse to investigate ?

Hi all,
I don't know if anyone can answer this.
The Independent Case Examiner is currently investigating the DWP for my partner's claim.
They have just refused to investigate one of the points - That a SAR request took 6 3/4 months to fulfill despite 6 requests and intervention twice by the ICO. They have said that this is because it is not in their remit to do so.
However looking at their remit on their site it definitely seems to fall into their categories/
I don't suppose anyone has had experience of this have they ?
