Got a letter yesterday that says
We confirm that your appeal has been received and that all action has been suspended pending adjudication .we will endeavour to respond to your appeal within 28 days.
I take it this isnt my popla code appeal which i asked for and No mention of photographic evidence which I asked for .
I take it this internal appeal will fail??
Was in asda last week and watched what the smart parking employee does .
He writes down the details of the cars and then seems to forget to put the tickets on the cars
4 weeks later the owner gets the invoice in the post ,panics and pays up ,bigger scam than putting invoices on the cars
He must be committing some sort criminal act by doing this ?0 -

Can you film him on your phone? Sounds like fraud if he's not ticketing cars - unless tickets are issued by ANPR instead. Maybe he's just recording time of arrival then checking later?
Sounds like that letter is their own appeals acknowledgement, you are not at POPLA stage until you get sent a 10 digit code for POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The BPA Code of Practice does allow for them to simply acknowledge your challenge in the first instance, in order to reply more fully later. Just wait until you get the next letter advising the outcome, which should include the POPLA code if it's a refusal.
If/when it gets to POPLA, one of your appeal points will be that they claim to have issued a Notice to Driver but have produced no evidence to this effect.
The ticket monkey you saw might just have been noting car details in order to come back later and check whether they have "overstayed", so I don't think there is much mileage in that.Je suis Charlie.0 -

The cars that get these invoices are normally parked on double yellow lines out the front of the store (causeing no obstruction to anyone )
so overstaying doesn't come into it
If they have used this trick against me and I'm pretty sure that's what he was doing the other day to the other vehicles , how many others have been victim to this even bigger scam ??0 -

Well you didn't say that before, you said you saw him writing down numbers but not that the vehicles were all on yellow lines as yours was.
If you want to do something about it write to DVLA, BPA, Trading Standards and, perhaps most importantly, Asda, telling them what happened to you (i.e. they claimed to have ticketed your vehicle when they didn't), telling them what you have witnessed with respect to other vehicles, and telling them all that, in your opinion, such behaviour could amount to fraud.Je suis Charlie.0 -

Yesterday they wrote again
" thank you for your recent communication received
I have noted the points you raised and would like to confirm that we are cancelling the parking charge notice
If I can be of any further assistance please do not hesitate to contact me "

For a start maybe teach the plank that you employ to fix the invoices to the cars would be a good start !!!!!
