Can bank charge me for copy of original terms?

Hi all

So sorry if this is in the wrong place, I wasn't sure at all which board was suitable.

I've recently asked my old bank (RBS) for a signed copy of my CCA for my Mastercard as well as my original overdraft agreement.

They've sent a letter back saying I have to write to a particular address and enclosed £10. I knew the could charge for the CCA, but didn't know if they could charge for the overdraft agreement and what the general charges were?

Just wanted to get some advice before I actually paid them the tenner!

Thanks :)

Lou x

If the debt is still outstanding then s77-79 of the consumer credit act allows you to request a copy of your agreement at a cost of £1.

if the debt is repaid/ account closed then the consumer credit act no longer applies and they do not have to comply with it. However, you can still request it under a DSAR (data subject access request) which costs you £10. There is also no guarantee they will still have it but they can keep the £10.

Why are you asking for it on a closed account? It can't be for PPI complaints as a its a credit card. It cant be for rule breaches as the account is closed.

If you have asked for a breakdown of charges then that would be £10.

The £1 method is purely for the agreement only.

Can I ask, would this be £1 per agreement or could the OP request both agreements for a total £1?

It is £1 per credit agreement. Not all for £1
