Leasehold property, landlord question.

Hi,

We purchased a leasehold property 7 years ago and have been paying a small ground rent to the Compton group since, it never occurred to me that there was any issue but on looking over my title deeds it occurs to me that this company are not mentioned on any documents and the name of the freeholder is that of a well known Mill owner in the town from the 1800's. They are claiming to be the landlords not acting on their behalf.

Should this company be named on the title and how can I ensure they hold valid claim? The law is so stupid that they would be able to make a valid claim to the title after 12 years of claiming rent that they weren't entitled to. I'd call it fraud but this is england...

    Can you provide the details of the register entry which refers to the ground rent please?

    The entry will often refer to the original freeholder only. Such ground rents are often sold on to specialist companies although there is also a process whereby they can be offered to the leaseholders themselves.

    The law is not stupid, it's your daft expectations :)

    The original deeds whether freehold or leasehold were correct at the time that the original seller and buyer entered into. You will see that your name is not on them either......

    The reason is that far from being daft that original deed or lease is assigned buyer to buyer, not a new lease or deed granted each time you buy or sell.

    In the same way that you change ownership the Compton group are the current owners and "successors in title". A simple check of the HM land registry will confirm if that is the case.

    Any demand for ground rent must contain the name and address of the landlord and the notices under section 166 CLRA
    2002 and under sct 47 & 48 LTA 1987.
