When I bought my house part of the contract was that I had to pay service fees to a management company.
I've always paid this by DD and on time. some how and I don't know if it was cancelled by them or by mistake by me, but the DD was cancelled.
I received the annual statement at the end of jan as normal and thought nothing of it as it was on DD
But then in April I received a letter stating I had til x date make the full payment as no payments had been made since jan.
it said if you wish to discuss payment instalments please call
My wife phoned them and explained that somehow the DD had been cancelled and could I please set it bsck up.
She was told that they don't do DD
My wife said we've always paid this way, The lady replied that may be but you can't pay that way as its not our normal business practise.
My wife then quoted their letter re the payment instalments she went off to check with someone, came back and said no, you have to make the full payment. My wife explained We were not in a position to do so
And is there anything that could possibly be done. The answer was a point blank no!
I then wrongly so buried my head in the sand and thought that they'd send me another letter asking for payment, they didn't and as the weeks went in I again wrongly forgot about this
Until a CCJ landed in my post box on Monday.
Now I know we owe the years service charge but I feel this ccj has been unfairly given to us as it stated in their letter that we could discuss payment instalments, which they refused.
In their documents they have sent with ccj they have blatantly lied too, but I can't prove this. They said that I phoned them and said that the money owing would be forth coming.
I did not phone them, my wife did and this was the occasion she asked for the DD to be set back up and they refused.
Do I just fill in the claim and admit the full claim which is now £460 instead of the £180 years service charge or do I have any other hope of disputing it as they refused my offer of payment even though on their letter they said they'd do this?
