rental deposit - protection scheme

Hi all,

im 8 weeks into my rental, and ive not had any details from anyone on where my deposit is protected with, who should supply this, landlard or letting agent ( landlord is doing management side of things, ie if i've a problem i go direct to him, rather than letting agent)

i've typed in my surname, deposit amount and postcode in the dps website and it says
A deposit matching your search is registered with The DPS but has not yet been protected. Please contact your Agent / Landlord to confirm your Deposit ID as your deposit may be protected with another scheme.

    1) Have you checked all 4 schemes?

    2) the LL is legally responsible

    3) if you want it protected, write.

    4) if it is not protected, he cannot evict you via a S21 Notice (it wouldbe invalid/unenforcible), but you can still be evicted viaS8 eg for rent arrears

    checked all 4 schemes, in 3 it says nothing found, in dps it says above, and there's no issues, infact landlord has agreed to end our contract early so we can move into our new house (we are paying for the LA to readvertise the place) , its just were getting ready to move out in 3 weeks, and im just getting things sorted paperwork wise and it just occured to me ive not had any log in details, i'll email the LL , does it make a difference to me if its not protected?

    Sounds like you have a nice LL. Glad for you he's agreed to Early Surrender.

    If there is no dispute over deductions when you leave, then it makes no difference. You leave, ask for deposit back (best in writing but afrindly chat may do - depends on relationship), he gives it to you. Sorted!

    Of course, if he wants to make a deduction eg for cleaning, damage, or rent arrears you can either
    * agree (then request balance as above) or
    * dispute

    If you dispute, and it's not registered, then you can't use the scheme arbitration process. Have to use the courts.

    But of course if not protected you can also claim 3 times the deposit via the courts as penalty.
