In your letter just state the facts to them

1. What you believe is wrong
2. Why you believe it is wrong
3. What you want them to do about it

If they dont come back with a satisfactory answer then you can go down the route of a more formal letter quoting relavant guidlines on defaults ect

Thanks Fevlo. I will try the direct, factual approach first. Any idea if they have a duty to respond within a certain timeframe and what that would be to any request on this? If I send the letter recorded and receive no response am I able to write directly to the CRAs and ask them to remove/amend the default, or will they do nothing without the say so of the creditor?

Im not 100% sure so someone may correct me on this but you could query it directly with the CRA's and they would query it with black horse direct.

Black Horse should log your letter as a complaint, if after 8 weeks you dont get a satisfactore response you can then go to the FOS.

Hi thanks Fevlo. I have just received my credit report back from Callcredit this morning. They have recorded the account balance as being £7,583 up until January 2012 (wrong amount) and defaulted the amount as £2,486 in February 2012. So the same date as the default with Experian but for a different amount!

I am drafting a letter to Black Horse first. Explaining that the timeliness of the default is wrong and the amount. I'm going to ask BH if they will remove it first. But think I will also send letters to each of the CRAs with a copy of the letter to Black Horse and ask for them to remove it too.

I'll send all letters recorded delivery and ask for a satisfactory response/outcome in 28 days. Does this all sound reasonable?

I'm assuming that if I write directly to the CRAs explaining the errors that they may contact BH also and ask for permission to remove or amend?

Double-pronged approach?

Sounds good to me, a double pronged approach may work, it cant be a bad thing.
The only issue I can see is that im sure they have 8 weeks to respond so I wouldnt worry about putting 28 days.

With the CRA's if you sign up to their free tirals then you can usually submit a form through their site claiming there is an error. Might save you a bit on recorded delivery charges

OK thanks Fevlo- I will change the time to respond to 56 days from BH. I've since noticed that Experian say

'TIP: If you find a mistake, you may find it quicker to contact the lender direct. If you do contact us first, we will contact the lender for you and will make this clear on your report.'

I'm sure I had seen somewhere about having 28 days to respond but cannot find it now. I'm going to write to CRAs and Black Horse and see what they come back with between them.

Hi Guys- well first letter back from Call Credit today saying that Lloyds are refusing to change their entries as they say it is correct so there is nothing else Callcredit can do.
Totally deflated- had a weep. Have come on here to see what I can try next. I don't mind the default appearing, I just feel it should show from the date the agreement was terminated and when Black Horse started saying the account was defaulted back in August 09.
Anyone any success challenging the late entry of a default? Who best to go to? I tried the factual this is incorrect approach and now wondering if I should complain to Black Horse with the personal approach. This agreement will have made me suffer from 2009 to 2018. I was forced from the property ladder and am being kept off it despite working three jobs, never claiming a benefit and four kids I just want to put in their own home. I was a homeowner for about 15 years before all of this. Had a bad business experience. Collected hundreds of thousands of pounds for HMRC and I am just so, so, so tired of being made to feel like a second rate citizen from a greedy finance company who has had thousands out of me and who for years and years I was a very good customer. So, so, tired.

Hi

Did you send a letter to black horse direct in the end? or just to the credit reference agency?

Sent a letter to BH and all 3 agencies. Not heard anything back from BH. Though they have tried to call again, first time in ages but I want everything in writing.

I know the dates and amounts are all wrong and even inconsistent between agencies. And I detailed all of this in my letters. Just don't know what to try next?
