If it is the case that the phone was just picked up and fiddled with rather that putting it up to your ear and its photographic / video evidence thats nobbled you - whats to stop someone arguing that it was an MP3 player that was being used.
Some MP3 players are pretty dang similar to Phones until you look closely.
Or would that just change the offence that you would have commited? (? to driving without proper control...)
Also just thinking - where do you stand if you have your phone fitted to your car and use it to play music through your car speakers. Can you change tracks when stopped at lights as you might with the car stereo (where you could even be physically changing CD's).Was it really "everybody" that was Kung Fu fighting ???0 -

It's driving without due care and attention. I am looking to get an ipod kit fitted in my car, would still need to change songs using the ipod, a police friend of mine recommended getting a cradle fitted so the ipod becomes "part of the dash" so it would just be like changing radio stations, as holding the ipod and searching that way could be an offence...0 -
