ccj from tennancy

A ccj that was registered in 2010 that i had no knowledge of....

If we contacted the court, today in 2013, to see where the ccj originated from etc... would it still be statue barred & drop off in 2016? 6 years from date of the ccj?

Or would it be 6 years from ringing the court as they made a note of conversation in 2013?

    CCJ's don't become statue barred, so whilst it will 'drop off' credit reference agency's after 6 years, the debt will still exist and can still be chased for.
  • I'd recommend paying it, as it will trail around for years otherwise

    Contacting the court won't prevent the six-year statue-barring clock from ticking. That's when you contact the creditor and/or acknowledge the debt. Your creditor still has three years to try and collect from you or sell it on to debt-collectors. Who are a great deal more aggressive and troublesome.


    How do you know it was a CCJ from a tenancy if you haven't contacted the court?

    A CCJ is never statute barred, but after 6 years the holder amay have to apply to the court to enforce it.

    If you ever buy a house the person who holds the CCJ could get a charging order against the house, and them press for sale through the courts, this would more than likely count as a default on your mortgage (cross default).

    The above is worst case, but possible, so get the CCJ paid off.

    But as mentioned it will drop off your credit report 6 years after it was registered.
