thinkaboutkids Gift voucher

Hi, I purchased a gift voucher from thinkaboutkids.com back in December 2012 as a Christmas gift for my nephew in Italy. He ordered things but they never sent them despite numerous phone calls back and forwards and promises and lies saying they had again been sent. He has never received anything. Now the owner(Dana) is not answering her phone when my number comes up. I have left a massage asking for a refund, but no answer. What can I do now?

Under Distance Selling Regulations, you can cancel an order upto seven working days after delivery of that order. You are clearly within that period, as the goods are yet to be delivered. Their T&Cs reflect that:

By law, consumers in the European Union have the right to cancel a contract for the purchase of an item within seven working days of the day after receipt of the order.
If you wish to cancel your order under the DSRs we ask you to please notify our Customer Service team quoting your name and order number:

by post to our address above
We will then arrange for you to be refunded accordingly.
Where you are cancelling your order within this cooling-off period we will refund the cost of the item and the cost of sending the item to you as follows:
where you are returning an item that was part of a larger order, we will refund any specific delivery charges that you incurred for that item over and above our Standard Delivery rate.
where you are returning your entire order, we will refund the Standard Delivery charge incurred.
where we collect an item from you, we reserve the right to recover the costs of collection from you.
There are two East London addresses on their website.
Now, there might be a couple of issues that could cause difficulties.
Firstly, the purchases have been made using a gift card. It is possible that any refund offered is back to the gift card.
Secondly, it is not you who have made the purchase of the missing goods. Yes, you bought the gift card, but your nephew bought the goods with the gift card.0 -

Has anyone else used the company in the original post thinkaboutkids.com?
I'm still waiting for goods ordered in February and have also had numerous telephone conversations and promise, but still haven't received anything. Are they usually this bad or am I an exception?0
