I bought my daughters dream prom dress of a date called dresses house. to have it custommade including shipping it was £147.
it arrived over a week ago and is 2inch too big round bust, 2inch too long and the embellished strap does not meet the embellishments on the dress. the zip is also faulty.
I have been in correspondence with the company who I think uses factory in China. I have sent pictures of her being measured and how big the dress is but they will only offer £30 to repair it or if in return it and pay the shipping costs they will refund the dress costs. but it will cost £70 to ship!
my daughter is devestated I know section 14 (2b) states my rights but I am unsure what to do next as IIT is costly to go to court.should I just get my money back through the credit card
any advice would help please

I take it you bought it from china? Even with a section 75 you could be asked to return it.
So I think you'd be better off taking the £30 refund and putting it towards a reasonable seamstress over here to take it in and up.0 -
You took a risk by buying from China, hence forgoing any UK consumer rights.
Your best option is to take the £30 and get it altered.
There are so many bad reviews of shoddy Chinese prom dresses and nothing people can do, so unfortunately you took a risk that didn't pay off.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
I am thinking of just claiming as I paid on my credit card through my provider
the warehouse is in China but company is based in UK dresses house.co.uk0 -
The website is registered in Massachusetts, USA. There is no contact number or address on the website.
Take the £30, get the dress sorted locally, then do a bit more research next time.0 -
£30 should cover the majority of the adjustments, maybe a little more changing the zip etc but you'd certainly spend less than the £70 it costs to return it.
In all honesty did you really expect the dress to be a perfect fit? My aunt made my prom dress (13 years ago, yikes) and even after she took my measurements I still needed to go for the odd pin and tuck every other week.
2" is a massive difference, yes, but even if the measurements of the dress were 'correct' when it arrived it still might not have fit well, and you might've needed to pay to get it altered anyway.
I would take the £30 myself.0
