ParkingEye Parking Charge Notice

Hi, I'm hoping you can help me! I've managed to confuse myself greatly reading the information on the main site and the threads on here. Some of the threads suggest ParkingEye is difficult to appeal so I don't want to get it wrong.

We overstayed in a retail park by 35 minutes according to the letter we received today. We were in and out of the shops in that time, unfortunately we paid by cash for lunch when we first got there but I have a bank statement showing purchases made in three stores during the time we were there.

Is this even grounds for appeal at all? Is the first step to follow the appeals process on the ParkingEye website?

Thanks in advance!

Well I would never follow any advice on a PPC's own deluded website but, actually, Parking Eye do often cancel fake PCNs when a person can show receipts of over an arbitrary amount (we think around £30). Like in this case (one of many):

    https://forums.moneysavingexpert.com/discussion/comment/61652365#Comment_61652365

So you could try a simple challenge, maybe not quite as rude as my version below (but do not name yourself or anyone else as the driver/shopper in question):

    ''Dear scammers,
I have received your laughable fake PCN. The driver was shopping in the retail park and here's a redacted copy of the purchases totalling £xx as shown on that person's bank statement.*

Cancel the fake PCN or send me a POPLA code and I will add a lot more to my challenge at that stage; as the registered keeper I have many grounds on which to appeal this invoice to POPLA.

    yours

    PRINT NAME (do not sign)''

Then just tell us what happens and if you have to use POPLA we'll help you to win that stage at the scumbags' expense.

    * obviously cover up all personal details, account number & sort code too.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you! We'll do that as a first step although unfortunately the amounts on the bank statement only add up to just over £20 and I can't find the receipt for our lunch.

Just put then that the driver & passenger also had lunch and paid cash of around £12 at xxxxxxxx cafe/restaurant too.

They cancelled it as 'a gesture of good will just this once'. Thank you for your advice!

Well done, just curious as to whether you sent a polite appeal or a dismissive/rude version like in my example? If it was the latter then PE have cancelled this because they've seen this thread and know it would have ended up with yet another POPLA loss.

My husband wrote it so it was a more polite response but telling them much what you said. He also added in a bit of a sob story about having 3 young children making shopping trips take longer than for other people.

We've just had another letter telling us our appeal was unsuccessful! Unfortunately we can't find the letter saying they'd cancelled the charge, we thought after 4 months that it was done and dusted!

Oh no! That's the one bit of vital evidence you should keep for at least 6 years (the time available to them to pursue you to court).

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Does this second letter have a POPLA code?
