    Sorry, that is not what I meant.

    Your contract will have a specific section for the hours you work.

    For example it might say something like 'you are contracted to work 10 hours a week as instructed by your manager. In addition you may be required to work such extra hours as the needs of the business dictate'

    Or it might say something like 'your normal hours of work are 10am to 2pm monday to Friday. In addition you may also be asked to work occasional Saturdays'

    What I need to know is what does your contract say about your hours of work?

    My contracted hours are 8-12 monday to friday and 4.30 am -7.30 a.m saturday

    I work 3 hours on a saturday.

    As in post #6,
    There isn't any extra statutory entitlement for working more than 5 days/week
    but the employer may offer more if they wish
    .

    This is why zzzLD is asking for the wording of your contract terms. It may be that your employer is offering holiday based on all hours worked rather than on the statutory minimum which only needs to take account of up to 5 days.

    Is it something to do with the bank holidays? You are only entitled to a pro rata rate for them?

    !The statutory leave entitlement is actually 5.6 weeks per year, so the 28 days per year is based on a full time employee working 5 days per week. A lot of companies are changing to hourly amounts, as a lot of working patterns are variable. If you are contracted for 23 hours per week, then your entitlement should be 23x5.6=128.8 hours.!

    Your boss has probably mentioned the pro-rata amount which is comparing your hours to a full time employee. You need to find out how many hours a full time employee works, to calculate your pro rata amount. For example if a full timer works 35 hours, then the pro rata is 23/35=65.7% or if a full timer works 40 hours then the pro rata is 23/40=57.5%. These both still equate to 128.8 hours entitlement.

    The 128.8 hours cannot be rounded down, it should be rounded up to 129 hours. The figure of 123 hours would make sense if you are contracted for 22 hours per week, perhaps your boss has miscalculated and used this figure instead.

    Okay, I think I know what they mean when they refer to 56% pro rata. What she is saying is that your actual holiday allowance (123 hours a year) is about 56% of what a full timer worker is entitled to. Which is probably right.

    I don't get how they have worked out your entitlement though. If they are taking your full contractual hours (23) that would work out to 128 hours (or 129 rounded up).

    Tick that you want to workout your holiday pay based on hours worked, and have a play with the calculator. I suggest that you then ask HR to explain how they have worked out your entitlement.

    One thing to confirm though. Your holidays are deducted from your entitlement on an hourly basis. So say you take a friday and saturday, that would be 7 hours off your holiday entitlement. But remember that your holiday entitlement also includes bank holidays. So if you normally get bank holidays off, you must allocate sufficient hours to cover the bank holidays before you start planning your holidays.

    Thanks I work bank holidays usually my shift is 4 hours but on a bank holiday I do half of my hours which I two do I take 2 or 4 hours from my allocated holidays hours-and I suppose christmas day must come out of these 129 hours as well

    If you work 2 hours when normally you would have worked 4, then deduct 2 hours from your annual entitlement.

    If otherwise you would have worked on Christmas Day, then deduct the associated hours.
