Parking fine-Euro Car Parks

Hi-just wondered if you guys could help, please.
My daughter has received a Parking Charge Notice from what I believe is a city centre car park (Wales) -not sure if the car park it's self is maintained by the council or not.
The first line states " Euro Car Parks have been appointed to manage the car park at XXXXXX City Car Park"
It's defiantly also states it's a PCN.
We have been away whilst this was received, and she has emailed stating that she did buy a ticket (she was there 1 hour). But of course, she can't now find the ticket as proof.
She is adamant she bought the ticket, and won't pay, but it worries me a bit that this could turn nasty. I don't mind (or daughter) receiving some threatening letters etc. But what I don't want is court action, bailiffs, etc.
Not sure if I should just pay the reduced amount (£40) and have done with it???

When you say "PCN" does that stand for "penalty charge notice" or "parking charge notice"? If the former, then it's an official council ticket, if the latter, then it's a fake parking ticket issued by a private company.

Was this a ticket on the windscreen - Notice to Driver (NtD) or on the basis of ANPR camera capture resulting in a Notice to Keeper (NtK), received through the post?
If the former, await the latter, and then come back to us on this thread. If the latter, could you give us some details please, viz:
Date of original 'offence'.
Was a ticket attached to windscreen initially?
On what date did you receive NtK?
Make NO further contact with the PPC (pity about your daughter's email to them already, but not a show-stopper) and definitely do not indicate who the driver was.
I've made a couple of presumptions here
a. It is not a hire or company car (advice will be different if it is)

No first she heard was a letter from Euro Car Parks-latter dated 21/5/13.
This is the only letter received as yet, and no response from her email.
"Offence2 was 17/5/13 between 12.39 and 13.41-no ticket on screen. I expect she had the letter soon after the 21st May when it was dated.
The car not hired and is registered to daughter. She is a student.
Must have been ANPR then?

I'm just giving this some more thought. Was it a key in your registration details at the ticket machine arrangement? If so, it's a possibility that your daughter might have keyed it in incorrectly, a transposition of two letters or numbers? But without the ticket it will be difficult to play that card.
So we'll have to tackle it as follows:
Do you have the NtK to hand? Can you scan it and upload both sides to the forum? You will need to mask any details that identify your daughter - use something like MS Paint to do that. We can then check to determine whether the letter is compliant with the BPA Code of Practice and/or the Protection of Freedoms Act 2012.
As the notice is to the Keeper, the PPC has to comply strictly in order to be able to pursue this with the Keeper (as opposed to the driver). Your daughter's email notwithstanding, there has been no confirmation to the PPC of who the driver was (and must remain like that).
If we can find a non-compliance, then that should mean the PCN is cancelled by writing to and pointing this out to PPC. However, even then many PPCs will ignore this and reject your challenge, at which point they are required to issue you with a verification code for POPLA, the independent appeals panel.
If you are unable to upload us a copy, thereby losing the BPA CoP/PoFA opportunity, you can go straight into a challenge to the PPC to acquire your POPLA code.
A 'soft' appeal is all that's needed - no need to tell them the (mitigating) story, doesn't work, don't waste any breath/typing on it. Just send something like this.
Dear PPC
PCN No xxxxxxxx
Car Reg xxxxxxxx
Date
I am writing to challenge this fake PCN. A ticket was purchased on the day, the full fee for parking was paid. No losses by the landowner were suffered and therefore no reason for any further charge to be made. Your punitive fake PCN is therefore no more than an attempted penalty - you have no legal right to issue penalties.
I require you cancel this penalty charge forthwith and confirm that you have done so in writing to me. If you do not do this, forward me a POPLA verification code so that I can put this point and a significant number of other relevant points to POPLA in a robust appeal.
Save for either of the above, do not correspond with me again.

There is every likelihood this will be rejected. When that happens, come back to us on this thread and we can take it from there.
The PPC has 35 days to accept or reject your challenge, otherwise they become timed-out, so make sure you keep an eye on progress. Keep us informed.

Definitely follow the above advice and tell your daughter if/when she gets a POPLA appeal code/form, NOT to just send the same appeal again. To win a POPLA appeal it should be more like the sort of examples as linked by Umkomaas when posting on pepipoo forums in post # 3 here:

So as she has already appealed you don't have to send anything else yet and wait for ECP to respond; or you could send that suggested second challenge (as above from Umkomaas) if for some reason you aren't sure if she emailed the right appeals address or something.
BTW Euro Car Parks are well known on here and they DO NOT 'get nasty' LOL!!
I have ignored and laughed at a fake PCN from them and they just send 3 letters - but that was before POPLA was around to get these annoying fake PCNs cancelled at the scammers' own expense. Much more fun nowadays, to cost them money as they have to fund POPLA stage to see their stupid fake PCN cancelled when an appellant researches the sort of appeal that will win!
I am just an ordinary wife and Mum, here because I HATE these scammers, and I would happily collect more of these pieces of rubbish when shopping.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
