First Direct PPI Claim Rejection

Hi
I have had a credit card with FD since 1996 and stupidly have been paying payment protection every month since then.
I have sent a letter to them saying that I would like a refund as it was missold.
I work for the county council and am paid if I am sick, which I have been over the years.
I received the expected refusal letter which I am assuming is sent to most people first, saying that it was my own fault and I had the option to cancel blah blah blah, but at the very bottom of the letter they said as I would have been paid when sick to send them proof and they will have another look.
With the refusal letter came photo copies of the original contract that I signed in '96.
Could anyone tell me what kind of a letter to write to them next?
I have the proof of sick pay from my companies HR dept.
I have been on long term sick a couple of times over the years due to mental health issues, but I didn't tell FD or claim on the policy. I know that the policy wouldn't pay out anyway even if I tried to claim.
Do you think its a good idea to tell them now?
I know I have been an idiot and should have done something before now but because of my 'head' problems, it was easier not to.
Thanks very much indeed.

If you send them proof of sick pay it is a re-invesitgation, and will not adhere to the 8 wek limit, They can months over it if they want to.

The toss-up is sending them the stuff and wiaiting for a bit, or forward it to the FOS strasightaway and wait up to 18 months.

You could send them the stuff they ask for, and mentally give them a certain amount of time before you refer it to the FOS so as not to miss the 6 month window from the full and final letter you've had.

    Thanks very much for that.
Thats what I will do then, I will give them 2 months to get back to me before I get the FOS on my case.

I would send them the info and as taff said give yourself a mental deadline b4 sending to FOS.

I had a claim with them which was recently upheld, for a series of loans. All turned around within 3 weeks. Realise your situation is different but lady did say they are working through stuff quickly so heres hoping they review yours pronto.

    Hope that helps

I have just had another read through the rejection letter.
It states that "taking into account all the circumstances, they are confident I had sufficient information to make an informed choice about the PPI.
As I purchased on a 'non-advised' basis, they dont believe there is sufficient evidence to uphold my complaint"
    Is this a standard reply?
    Thanks very much

How did u apply for the card?
Presuming because it was 1996, no internet etc and thus it was my phone?

Did you ask for ppi or did they just assume you wanted it?

Do you have any medical conditions that were present when you took it out?

There are certainly template letters used for replies, but they are not simply "standard" in that they take account of each individual's circumstances.
In this instance it would appear you were "not advised" because you applied for the finance by filling in an application form by post. This means that, if anything, you mis-bought the insurance rather than were mis-sold it since no bank staff will have advised you.
Presuming because it was 1996, no internet etc and thus it was my(sic) phone?
If it was made by 'phone, then this would have been deemed an "advised" sale. In the absence of internet so long ago it can only therefore be a postal application as the bank are saying it was not advised.

    Thanks for the replies
It was by post that I applied. I think the Credit Cards was offered to me when I opened a bank account with them.
Do you think it is worth me trying again with them or should I just forget about it and put it down to experience?
I do have a medical condition now but this wasn't diagnosed until about 1999.
    Thanks for your help

Since you appear to have no complaint, I'd say continuing your quest will prove futile.

    You mis-bought.

Pretty much all of First Directs business at that time was done via the phone, and I filled the form in after speaking to a rep.
I will go ahead and post the sickness pay proof and see what happens.
    Thanks for your time.
