    How much research on this forum have you done? When I first came here I read until the early hours for days and nights on end (and I've never had a PCN, just trying to help someone out) to acquaint myself with the issues.

    What happens if you fail at POPLA?

    Well, the judge puts on a black cap and says 'You'll be taken from here to a lawful place of execution, where you'll be hanged by your neck until you are dead'. That's the time to be really worried!! Are you frightened of spiders?

    With help from here you really shouldn't lose at POPLA (100% success rate so far..... and gaining more fine-tuned experience wih every adjudication that is delivered). If you win, POPLA tell the PPC that they must disappear from your case, if you lose then there is (still) no obligation on you to pay the PPC anything.

    Now, go and try to read up a bit more - this is YOUR case after all.

    PS - sorry to be a bit sharp, but there is so much easily available information on here that regulars put so much time and effort into producing, it does get tedious to have to repeat the same well published advice already out there.

    All that said, still come back later if you need help with a POPLA appeal :)

    If you lose at POPLA you are just back to square one, ignore mode (people have ignored fake PCNs for YEARS!!).

    But POPLA is worthwhile as it costs the scammers money and we know how to win these appeals. You will win if you do a strong appeal to POPLA like the ones I posted for this newbie to work with (see post #15) and read the links, copy & paste the paragraphs into a long appeal, only deleting any that clearly do not apply. If unsure leave the appeal paragraph IN and show us the long draft you come up with:

    So let's see your draft. By the way as you've been looking here on the parking forum for 3 weeks, why on earth were you surprised when the scammers rejected your appeal? Of course they would! You need to read other threads and learn more about this scam.

    To be factually correct for the OP and any other Fistral threads, Britannic Industries lease the car park from Cornwall Council.

    The article in The Newquay Voice suggested, incorrectly, that Britannic owned the land

    The lease runs until 2138 at the princely sum of £13.8k pa. Whilst this might sound paltry, we have no idea how much Britannic invested in the upgrade of the infrastructure at Fistral and their operational costs, which include beach cleaning but not Lifeguarding.

    What is unlikely to have been factored into the lease agreement between Cornwall Council and Britannic Industries, is the ability of a 'remote' third party, PE, to extract, according to one source, up to £250k in a year in additional Parking Charges from the land.

    They don't get that much by allowing appeals.

    The name Britannic Industries may suggest a grand organisation but is, in fact, a Newquay based property company with husband and wife Directors.

    So PE are even less likely to be able to show 'a contract from the landowner'! :)
