Help needed with credit file corrections.

In late 2010, after years of struggling with debt (since 2003) I made a trip to the citizen advice centre and spoke to someone to see if they could advise me on what to do, as i just kept falling further and further into debt.
The solution they came up with was a DRO, i was advised to stop paying creditor whilst the application was made, it was finalised in march 2011 and accepted, after a year passed I was debt free
I decided to get a copy of my credit report to make sure everything was in order, I was alarmed to see a creditor had started proceedings against me and in Feb 2011 had registered a CCJ against me at Northampton County Court, this creditor was registered on my DRO so i assumed that if i contacted the credit reference agencies they would update my file and mark the CCJ as settled, but experian are refusing to do this, as i have to contact the court to get it corrected, ive tried to do this but keep getting ignored, am right in thinking this should be marked as settled on my file, and if so how can i get it sorted, no one seems to want to listen at all, i had no issues when i got a capital one account amended but this seems to be an issue or should i just leave it as it is my fault for the debt problems in the first place.

It works the same way that CCJs do with bankruptcy. The CRAs just report the information from the Register of Judgements & Fines held by the Registry Trust. To get the info changed you have to get the court to amend it, which in turn changes the register, which then finally is passed on to the CRA.
Now the usual interpretation the court puts on a CCJ being settled, is that it is paid. It may be covered by a DRO and hence is unenforceable against you, but as far as the court are concerned it still exists and is unsettled.
Not saying that is right or fair, but most of the time that seems to be the line the courts stick to.
However, you can ask for them to mark it satisfied and see what they say. Occasionally they will agree. If they are ignoring you then you could apply formally for a certificate of satisfaction. If you have evidence that the creditor considers the matter settled then that may help. You still get knocked back though......
Saying all the above, if the CCJ is dated before the DRO, then the effect of the CCJ (settled or not) is minimal to none on your report. The later dated DRO is a bigger blacker mark on your file that the CCJ ever could be, so it's not worth stressing overly about the CCJ not being marked as settled.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
