House & Care Home Fees

We assume the house must be sold immediaetly to pay the council when they bother to give my mother an itemised bill. So far they just throw figures out which she intends to question. Council want the house sold ASAP & they demand their debt takes priorty over all other debts including funeral costs. We are in Scotland if it makes a difference? My mother is considering renouncing her duties if she is allowed to so that I can take over or a Solicitor who specilizes in this sort of area but not sure if she can pick someone else. Mum is not very internet saavy does not get out much & has no photgraphic ID which she thinks pay cause problems down the line with officals.

At present the house is secured but not insured as company has terminated policy & we can not afford to insure it.

Any advice much appreciated.

    Best thing is to probably walk away and let someone with a financial interest deals with the mess.

    Definately don't do anything till it is clear the estate is solvent.

    if a benificiary and there is enough left think about getting involved.

    Just because you are named executor in a will does not mean you have to do it.

    If you renounce thats it you, can't apoint someone else there is an order in law.
    you can apoint an atourney(you) but if there is more bother than it's worth let the council sort it out.

    One other thing ignore the demands of the council, AUIUI unles they put a charge on the property they are in the queue of unsecured creditors.

    Don't pay out any money for anything even consider not instructing the funeral directors.
