non fault claim

My sister was involved in a non fault accident recently. Her car is a write off. The lady who hit her admitted liability.

Now I know she is likely to be hit by higher premiums for 5 years due to the statistics and the fact that she is sooo much more likely to be involved in another accident :o

However I have seen on here a few people saying she can possibly avoid this, if she doesn't accept a full and final settlement. How can she claim against the future increases so she doesn't have to suffer for some old womans poor driving?

I'm not sure it's possible, but hearing these whispers has made me ask. Is there a way?

    Accepting full and final settlement or not makes no difference at all.

    There is nothing you can do to avoid it, though some insurers dont load for a single non-fault accident, but some have successfully argued for a up front cash sum to cover the 3-5 years of possibly increased premiums.

    Who is dealing with her uninsured loss recovery? Does she have solicitors under a legal expenses policy or is she dealing with it herself?

    If the former than ask them. If the later then its going to have to be a case of doing some calculations, rationalising the amount you want to claim and submitting it with any evidence you can provide (namely screenshots of premium changes with and without claims) but dont hold your breath in being successful as it is a fairly tenuous head of claim.
