Harveys furniture problem

Hi Im after some advice. On the 1st of April we had a look round a local harveys store and found a sofa we liked. Rather than buy it we went home to check if it would fit. I then phoned the local store and placed an order. When I eventually got my receipt through which was about 2 weeks later, they had stuck insurance on it. I remember the salesman when placing the order trying to sell me the insurance originally at £150 and coming down to £85 it was quite a hard sale but I did not want it I told him to send me the details out and I would look at it.
I am so angry that I want to cancel I have signed no contract with them yet they have took £180 and are refusing to refund me my deposit. I contacted there complaints deposit and was told i was covered under distance selling rules but the shop is adamant I am not.
I think I am but am I and whats my next step. Surely they have broken the law by adding stuff to my order without my say so. I have not took receipt of the sofa.
Any advice much appreciated thanks.

If you said no then they can't charge you for this. I would give local CAB or trading standards a call to check distance selling regs as you had been in store. Although to be honest I can't imagine why such a big company would refute it and not give a refund. Rather than contact customer service try calling and speaking to the store manager direct, and if that fails ask him who his area manager is, that should make him buck up and give you the refund.
If I was the manager I'd be refunding and letting you keep it free of charge!0 -

As far as I am aware DSRs don't apply if the customer has had the opportunity to examine goods in store even though he has subsequently purchased 'at a distance'.

There is a good chance that Harveys will have recorded the telephone call and if they have done so, you are legally entitled to a cpopy of this recording. (you can be charged up to £10 for this).

It is likely that Harveys will claim that they did not record, or cannot find recording. that is what usually happens when it is not in the interests of an unfair retailer to find real evidence.
Letter before action is needed! Give them 2 weeks to refund. They have no evidence that you agreed to purchase insurance. You will win 100%, and they know it! They will refund.0
