tenant is paying her rent through her lawyer?

    Did your letter with 24 hours notice say it would be an inspection?

    Inspections are often carried out without tenants being present and your tenancy agreement probably mentions that you may conduct them.

    Even if your letter didn't say it would be an inspection you could probably argue it was implied and warranted due to them trying to give notice and being late with rent.. just bear in mind that tenant may see it as hostile regardless. Also they may have changed the locks - they are allowed to do that.

    Pretty much.

    Unless you have a legitimate reason for entry, such as to make immediate and urgent repairs to prevent further damage to the property, or in the event of an emergency, etc.

    Why do you want to go in if they are not there? I thought the whole point was to talk to them?

    But no, you can't just go in, even if you've given notice. It is their home.
  • well well well.....

    this is an update on my tenants situation.

    if you dont know, the tenants said that they has paid their solicitors my rent and that they will be in contact in due course.

    they still havent paid the rent which was due 22nd may - so i went round there saturday to check the property out and just have a chat with them along with a member of the LA. prior to this, saturday morning i received a letter from the tenants solicitors which said nothing about the rent and said that the property had a lot of mould in it and that "mould casues skin rashes which may affect the well being of the 4 month infant". I asked the tenants what the letter was all about as the LA had not had not been notified of any issues that were brought up in this letter.

    so where do i go from here? the tenants wouldnt say anything to me, they just said "speak to my lawyer, anything he says we do". i tried to ask them about the rent and if they had paid the solicitor the money and they wouldnt answer the question and would fain ignorance and all of a sudden their english wasnt very good....

    shall i wait to see if last months rent turns up or just cut my losses and get them out?

    any advice as always, greatly appreciated

    What mould? Have they been in touch IN WRITING about this alleged mould?

    Has there ever been a problem with condensation and mould in the property previously? If not, then the issue has been caused by your tenants not heating and ventilating adequately. Most probably by drying laundry indoors.

    nope nothing in writing at all, the letter from their solicitors also mentioned electric safety, but when we went to see the tenants saturday i asked them SPECIFICALLY if there were any other issues with the houses and they said no... how do i go about them paying last months rent though...?

    im getting nervous :(

    Electrical safety? This is what Shelter England has to say about this:

    Your landlord is required by law to ensure:
    • that the electrical installation in the property is safe when your tenancy begins
    • that the electrical installation is maintained in a safe condition throughout the tenancy, and
    • that any appliance provided is safe and has at least the CE marking - this is the manufacturer’s statement that it meets all the requirements of European law.
    In order to meet the requirements your landlord will need to carry out regular basic safety checks to ensure the electrical installation and appliances remain in good working order.


    A good landlord should have an electrical inspection carried out by an electrician before a new tenant moves in. If your landlord has done this, they should let you have a copy of the inspection report (known as a periodic inspection report).



    Each electrical appliance in the property should - if it has been checked - have a PAT (portable appliance test) sticker on the plug. This shows the date it was tested.

    If the electrical installation and appliances in your accommodation have not been tested, you can ask your landlord to get an inspection done - although they are under no obligation to do so unless you live in a house in multiple occupation (HMOs).

    I suspect your tenants may be being encouraged to clutch at straws. Have they ever brought any concerns they might have to your attention?

    nope nothing. not only that but the LA has just sent me their response to the tenants solicitors and it mentions that in a previous inspection there were barrells of fuel in the property...

    "I am also advised that it has been witnessed that the tenants have held barrels of fuel inside the property, under the terms of the tenancy we do not allow this. Under the terms of the Tenancy Agreement the tenant agrees".


    shall i just get them out??
