Thieving robbing Bankers... [Barclays]

Hello all...!

I am currently in debt to Barclays. I owe them approx £1600 on my current account which they have transferred to their own Credit Collection Agency.

I've been trying for ages to make arrangements to repay this debt for a long time but they've really hundered me - not accepting my offers and offering me a dodgy loan of £4000 over 10 years to repay the loan...!!

I also have another account with Barclays which has always been kept in order - never going overdrawn as it is a basic cash card account.

However, I have always had my fathers pension paid into this (which is clearly shown by a DWP credit on the statement) but today the money has gone. I believe Barclays have offset this - even after agreeing that I could make a token repayment of £5 on Thursday. This was agreed yesterday.

I am also entering into an IVA with Payplan - and I have also advised Barclays of this - who really don't seem to be interested.

What I need to know is - can they offset money that doesn't belong to me? I can easily prove this with paperwork from my father.

I AM making efforts to repay the debt, I HAVE made them several offers - and to be honest, the missing hundred pound or so is REALLY going to drop us further into the mire for another week... :confused:

  • I would advise first of all you get another account open for your father's money.

    What about reclaiming bank charges? Have you incurred any?

    Set up a basic account with another bank and have the pension paid into there. I shouldn't have thought they would be allowed to remove money without prior notice. They could argue that it is in your account and it doesn't matter that it it actually your fathers money, how are they to know? (I have payments from the DWP for my Tax Credits, the bank don't know that some of this money is my husbands - who doesn't have a bank account)

    Yep - I'm currently reclaiming about £700.00 which they've sent me a letter today referring to. Although we have closed your account we will send your money to the debt collection agency - not to you.

    Cheeky monkeys.

    That's like me stealing £100 from you - and when you find me out and I have to give it back - me saying, yes - you can have it back - as long as you spend it on DVD's for me. lol

    Back to the Ombudsman to complain.

    Thank you ever so much guys... I have sorted out a new account - this is just the transitional period.

    All your advice is much appreciated - it turns out they can't take benefits against debts - under the Social Security Act. Fab.

    Often it’s convenience, as the older person needs significant help with his or her banking or shopping.

    fbs, you don’t need to worry about whether it’s benefits or not. Any money you hold in your own name, but that belongs to someone else, can’t use it to pay off your debts. banking: firms' right of 'set off' explains this.

    It may be convienient but the bank are likely to ask OP to put a stop to it if found out or give notice to close the account.
