Mis sold Capital One PPI

Hi, I have recently written to Capital One requesting a refund of PPI payments(from 2004) that I had been paying monthly on my credit card. For years I have not taken much interest in the statements, as the card was to the max, and in was paying just the min payment each month.
Cap One's ,rejected my request.Their response was that the card was taken out in 2001,and sent copy of the original agreement, with a NO in the PPI box. They say that apparently in 2004 I had purchased the PPI over the phone, although they failed to enclose the acknowledgement letter they had sent to me confirming this.
I am in the process of writing to them again before going the FO route.
Has anyone experience of same and any successes against Cap One?

    If you only asked for your money back then you would be rejected. That isnt how it works. You have to identify a wrong doing and either hope they auto payout or they can identify a failing at their end or you have the evidence to support your complaint to give them.

    Most Cap One credit card PPI are bought over the phone.

    Asking them again won't aid your complaint. You need to focus on your complaint reasons and provide them your evidence. Cap One have a very low uphold rate at the FOS (just 22% in last period and 11% in the one before that).

    You will likely need something stronger than that. most cap one PPi sales are over the phone. The FOS has accepted their script as being compliant. So, typically you need a stronger reason to succeed.

    Realise that your first letter will have already been deemed a complaint and investigated as such. Writing to them again will just result in a reiteration of the original rejection unless you can somehow counter their reasons for refusal.

    The fact that they didn't send a copy of the acknowledgement letter they sent at the time is not cause for complaint. As the complainant, it is you who have to provide evidence of wrong-doing, the Bank's evidence is that you continued to pay the PPI you say you didn't agree to despite it being on every monthly statement.


    You'll have to go to FOS, but do realise that your complaint is very weak and you have no documentatary evidence to back up your assertions.
