The caravan and the house are both in her name according to this thread and she wants to keep them.

If I was her ex, I'd assume she was messing me about and deliberately not trying to find £100 so she could hopefully retain the house and caravan.

I still don't understand how you can be servicing a mortgage but not have the ability to find £100. What if a window or the boiler broke? If you can't find it you should be thinking about moving to somewhere more affordable.

When her Ex puts in for the absolute, she can object and ask for it to be postponed as financial matters have not been concluded.

How is she affording to use solicitors if she cannot afford £100 for a mediation session?

If money is very tight, then she may be eligible for publicly-funded mediation (I think this is separate from Legal Aid).

Mediation is still voluntary. She can refuse to attend, the mediator her Ex appointed will then issue an FM1 form to say that she has refused it, and court proceedings for financial division can continue. (I refused, I had my own reasons!)

I would suggest that your partner high-tail it over to the Wikivorce website to read their guides on proceedings. She can probably save of her solicitors costs by getting free information and advice from that site & its forum.

  • Anything she can sell on ebay or gumtree? Who currently has caravan? If she has it get her to put it on ebay and split profit 50/50 with her ex that way she will have money for mediation and no comback about selling marital asset if she splits money with him.

Has she phoned mediation people? They offer sliding scale of fees and she might not have to pay anything. Or maybe she could pay them in installments.

If all else fails is there a bill that could be missed this month to fund it? Once assets divided up she could pay missed bill

The legal aid rules recently changed as far as I am aware.

Yes they did, but the OP refers to a divorce that started in October 2012, before the rules changed.

Yes they did, but the OP refers to a divorce that started in October 2012, before the rules changed.

The OP mentions that the partner has solicitors, Im assuming that if she has already got a legal aid application in, it wont cover the cost of this mediation, otherwise it wouldnt be an issue.

What I mean is, it looks like the lawyers are being paid for, but the mediation session isnt.
  • Oh yes, I see. Could the OP clarify whether his partner gets legal aid for solicitors fee's then?

    OP, lend your partner £100.

    Problem solved.
