RBS Have taken money out of my account without permission

Hi

This is my first post but could really do with some advice. I bank with RBS and have 3 accounts, a savings account (which is basically where i transfer my rent and petrol money for the month so i dont spend it) a current account where my wages and bills come out of and basic account which is £99.18 in debit.

I have an arrangement in place to pay back £5 per month and have done for the last 6 months, never missing a payment.

So today i have checked my account and £99.18 has been taken out as an inter branch transfer.. What the hell?

So after some google searching it seems that banks are taking up a stance known as 'Setting Off', which on the front of it looks legal? and the banks have done to many people.. b i have enough to cover my bills which come out in 2 days and after that i will have nothing..maybe even to the point where some bills may get rejected..

Obviously i am going to ring them in the morning but where do i stand and what if they refuse to give the money back, what can i do?

    They have the right to off set so legally they have not done anything wrong.

    So you paid back £30 over the past six months, yet they still took £99.18?
  • I'm sure I have seen there right to do this in there terms and conditions.
    Yet, If you have an agreement with them - in writing - to pay the £5 off per month over a set period, then you would expect them to honor that.
    The only thing I can guess - is perhaps the agreement was for six months, to allow you time to reorganize your finances, to pay the amount you owe them, in Six months time - and they took the £5 payments as 'Token Payments' ?

    But, the hypothesis above is just my opinion and is likely to be wrong.
