There are no "spare" houses. They will want to know pretty much exactly how much "assets" you own before they agree to house or pay you. now if these "assets" include a share in an owned house they will definately want to know as they will force the sale in order for you to realise "physical money" in your account and therefore possible lower any amount of further money they have to give you.
They will not care about the status of your ex partner or teh fact he has to sell the mortgaged home, they follow the law.
All of what i have said is beneficial to you personally so im not sure why you would be against such a course of action?0 -
You need to get proper advice as to your rights and entitlements so go to CAB urgently. I agree with those above, if you leave the house voluntarily, and give up any claim on the equity, you are making a very serious mistake, and it will affect your benefit entitlement. Are there any issues with physical violence as this may also affect how you are treated if you choose to move out?

The majority of the payments for mortgage, deposit and bills etc has come from him and also his family in a way. I know i have not contributed much financially so do not feel morally it would be thr right thing to do to take half of the house/make him leave etc.
For benefit purposes where you leave a house in which you have joint ownership, irrespective of who has paid the mortgage, deposit etc, where there is no ownership dispute and no divorce proceedings and no dependent children living full time in that house then you are considered as having capital of 50% of the equity of the property (minus 10% for selling costs). If your share of the capital value is over £16,000 then you won't qualify for any Housing Benefit or Council Tax Benefit and if the DWP consider you have capital in the property you are not living in then that might impact on you qualifying for means tested benefits.
Following entanglement the capital value would be disregarded for 26 weeks - but after 26 weeks if reasonable steps haven't been taken to sell the property then the capital value is taken into account.These are my own views and you should seek advice from your local Benefits Department or CAB.0 -
Hi I cannot find any help in answer to my questions which have some similarities to the above.
I own my house with mortgage as tenants in common with my husband and we have seperated as we can no longer live together.
My husband and 19 year old son (in education) still live in the house.
We have put the house up for sale
I am renting a room and have made a claim for LHA from the council.
The DWP has now asked me to complete an A64A form in regard to the house.
Why do they need all of the information requested on the form? Some of it seems irrelavent to me.
Also i have been told that I may not continue to receive ESA even if I am deemed unfit for work after my assessment, because I own some equity and am not living in the house.
My husband has said he will move out until the house is sold if this would make any difference.
He is currently paying the mortgage and would continue to do so if I moved back in.
Please can you give me any better understanding?
