Advice A Business T&C's Consumables Not Eligable For Return'

I am a small business. I ordered via a Large Company website a print cartridge (£72) for my printer. (Sublimation Printer) When I received it I realized that I had ordered the wrong one, I couldn't exchange as they don't stock the one for my machine, so I emailed the company explaining what I had done and stated that the box had not been opened, I requested for a returns authority. To which they replied: "Unfortunately as stated in our Terms & Conditions Consumables are excluded from return" :mad: Surely this can not be right. I had a quick look at the Distance Selling Act on this site and did copy and paste a section about Companies excluding returns into my email back to them, which I await a response. Please advise as otherwise I will be stuck with a £72 ink cartridge that I can not use.:( (I have been an account customer with this company for over 5years.)

    I think the distance selling regs are consumer protection, if you bought as a business they may not apply, if it was me I would give them a call and politely ask them to give you a break as a loyal customer if they won't there's always ebay.

    Unfortunately, it looks like you will be stuck with the cartridge as the Distance selling regulations only apply on business to consumer sales and not business to business ones.

    You could always try selling it on somewhere like ebay.

    If the consumables is sealed and unopened, it's pretty shoddy service to at least allow an exchange or credit note... but unfortunately not against the law and DSRs are for consumers.
