I bought a laptop from my local Currys on the 13th Jan this year and decided to take out the 2 yr payment plan with Creation finance, I hadnt told my husband that I chose that option nor did I need to as I had given the sales assistant my own Bank details, however 5 months down the line (after going in and saying that no direct debit has been took out my account ) my Husband told me that creation was taking money out of his account a totally different account and indeed a different bank !!! it seems the system prepopulates back to a old agreement me and my husband had taken out 3 years ago using his bank details. It seems I have signed for it even tho I was not named on his account ....now currys have admitted the system does this and its a training issue that staff dont point this out and has offered me £40 out of pocket expenses ...which I have refused, as I feel they have breached data protection. confidentiality and comitted fraud on my husbands account, I have said I'm prepared to take this to the Ombudsman and am now waiting a reply ...just wondered if anyone else has come up against this as well

    No breach - did you not check the forms before signing? As an existing customer your address would pull up the previous details, Carphone Warehouse do this too. It was sloppy, and they offered recompense - you are unlikely to get more.

    The real injured party is your hubby, did he not complain and challenge it at the time of the first debit? If not, he will be seen as complicit.

    What is it you would like from them? I presume it is more money as they have already investigated to see the cause and have offered £40 as an apology.

    Out of interest, what part of your data have they not protected?

    I still fail to see how that is a breach of the DPA.. it is poor customer service, and potentially against a credit act (I'm not clued up enough of the relevant acts), but nothing to do with DPA.

    If someone enters a credit agreement and wishes to keep that fact from their OH, that is their prerogative. If the company acts in such a way as to breach that right to privacy, there is a potential DPA issue.

    Isn't your real problem with Creation?

    If currys took all your details, all they would of done was pass that onto Creation for the finance agreement. If Creation decide to take money out of your hubbys bank account instead of yours then (from what I've read) theres nothing wrong that Currys has done.
