Overpaid rent

So I've overpaid my rent by one month - left standing order in place.
Landlord gone dead quiet about returning the money. Tried phoning left voicemail msg.
I've now sent a letter recorded delivery, how long do you reckon I have for it to be valid with the small claims court. Rent was overpaid end of april.
We've not threated action [yet], have been polite.
We have done nothing wrong, its basically immoral he keeps the money.

When did you move out? Deposit settled?
Leave your letter for 3 weeks - unless you indicated some other time scale. Send another letter headed 'Letter Before Action' giving say 21 days before you will take legal action. Send 1st class from a Post Office, get proof of delivery. Wait say 4 weeks and then sue.You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'0 -
